Access and termination conditions
Conditions for providing of access and interconnection to the public electronic telecommunications network of Orbitel EAD
І. Access and/or interconnection to the network of Orbitel EAD
1. Orbitel EAD („Orbitel”) in its capacity of an operator providing electronic communications shall provide access and/or interconnection between its public electronic telecommunications network and the networks of other operators which provide electronic communications according to the Electronic Telecommunications Act.
2. The interconnection under item 1 shall be ensured with a view to provision of electronic communications services.
3. Detail description of the conditions for interconnection is provided in the individual contract for interconnection with the fixed network of Orbitel.
II. Interconnection provision
1. The interconnection shall be provided in case the following conditions are at hand:
а) Conclusion of an individual written contract for interconnection;
b) Provision of an optic connectivity between the network of Orbitel and the respective network of the operator with which the individual contract for interconnection is concluded;
c) Successful completion of the technical tests of the systems of the operators.
2. Orbitel shall provide a template of the contract under item 1, letter “a” upon receiving of a grounded request made by an operator, providing public electronic telecommunications networks to which the Communications Regulation Commission (CRC) has provided the right for initial use of numbers of the National numerational plan (NNP) for provision of electronic telecommunications services. The contract shall be concluded within one month as of the date of submission to Orbitel of the request for interconnection by the respective operator.
3. The interconnection between the networks shall be performed through an optic connection set up between the access points of the parties. The access point of Orbitel is located in the city of Sofia, 1 Macedonia Sq., floor 21.
4. The expenses for the setting-up and maintenance of the optic connectivity between the access points of the parties shall be equally shared among the latter.
5. Each of the parties shall be obliged to provide at its own expense the technical equipment in its network which is needed for the setting-up and maintenance of the connection to the other’s party network. The technical equipment should be in compliance with the applicable national quality standards and should be in good working order.
III. Technical configuration of the interconnection
1. Configuration of the connection through direct H.323 interconnection as per H.225.0 Annex G ITU recommendation.
2. Routing towards the interconnection access points of the parties shall be performed according to the following signalization protocol: ITU of H.323.
3. Internet Protocol (IP) shall be used as a basic protocol of the connection – direct IP interconnection of the networks of the operators.
4. Possibility for remote access to the equipment of Orbitel as per the signalization protocol shall be ensured.
5. Capacity of the connection: In accordance with the available free network resource and the technical characteristics of the equipment of the operators.
VI. Numerational plan
1. Orbitel provides interconnection to its network in each district in whose national district code (NDC) Orbitel has initially provided numerational capacity.
2. Length of the numbers: Orbitel uses subscription numbers where the length of the numbers is with 8 digits, including NDC, and the national regulated NDC are being used.
3. Forwarding format: towards Orbitel it should be forwarded as follows: NDC Х1Х2Х3Х4Х5Х6Х7.
V. Services, provided by Orbitel within the scope of the interconnection
1. Termination in Orbitel’s network of voice phone calls, generated in the network of the other party or transferred through it;
2. Call forward to all national networks numbers:
a. unconditionally;
b. in case of “Bussy” signal;
c. in case thers is no respond;
d. in case the subscriber is not accessible;
e. depending on the origin of the call;
f. depending on the time when the call is made;
3. Call put on hold;
4. Call waiting;
5. Conference call;
6. Calling line identification;
7. Calling line identification restriction;
8. Transit to ported number.
VI. Quality of the services within the scope of the interconnect
1. Orbitel constantly maintains the services’ quality which is in compliance with the applicable legislation of Republic of Bulgaria and the Permits issued by CRC.
2. Within the interconnect Orbitel ensures that the end users may use the services with a quality which is not lower than the quality ensured in their network.
3. Parameters maintained in Orbitel’s network:
3.1. Availability – not less than 99.90% within one calendar month;
3.2. Average monthly transit IP packages delay in one direction – less than 50 ms. within one calendar month;
3.3. IP packages loss – not more than 1% within one calendar month.
4. The parameters under item 3 shall be met in case the optic connection between the access points of the operators is loaded up to 60%.
VII. Exploitation and maintenance
1. Orbitel shall remove in due time the problems in its network which prevent or may prevent the provision of the services with the necessary quaility.
2. In case of technical or other problems which may seriously disturb the traffic termination quality, Orbitel shall inform the other party for the occurred problems. The notification shall be made in due time but not later than 15 (fifteen) minutes as of the time when the problem has been specified.
3. Orbitel shall perform a constant control monitoring of the interconnection technical parameters. The parties shall periodically, within periods not longer than 120 (one hundered and twenty) days, exchange information for their control monitoring under the preceing sentence.
4. During the exploitation of its network Orbitel shall ensure the lack of:
a. overload or break off of the other’s party network;
b. overload or break off of its own network in case this is going to affect the network exploitation and the quality of the services of the other party.
VIII. Financial conditions. Taxation rules
1. For the termination in Orbitel’s network of telephone traffic originated in the network of the other party or transferred through it, the operator which is a party to the contract for interconnection shall pay Orbitel termination price amounting to:

2. The above stated prices are applicable only to traffic towards geographical numbers.
3. The total volume of the calls shall be charged as follows: the duration of all calls (in sec. for each point of interconnection) within a given calendar month shall be accumulated and the total amount shall be devided to 60 (sixty). The roundness shall be made to the last minute started.
4. The duration of the telephone call for which payment is due shall be defined as the period when the signal for establishing connection is received by the called party (B-user) and the receiving of a signal for connection break-up. The connection may be breaked-up from А-user or B-user.
5. In case the call is forwarded towards an office message in the end station of the called party, the call shall not be charged due to the fact that in this case a signal for “call start” shall not be generated.
6. The prices under item 1 shall apply for all calls forwarded to the other network including when the calls are forwarded to numbers which are not being chared in the other’s party network.
IX. Grounds for refusal or limitation of the interconnection
1. Orbitel may refuse or limit the provision of the interconnection in case any of the following circumstances is present:
1.1. to guarantee the safety work of its network in case of force majeure due to natural disasters or network failure;
1.2. to ensure the integrity of its network in case of possible violation of the exploitation and/or management of the network or its elements;
1.3. to ensure the protection of the personal data and the secret of the communication;
1.4. absence of technical and physical possibility for ensuring the interconnection;
1.5. CRC’s decision for complying with a temporary restriction request which decision is entered into force or its preliminary execution is allowed;
1.6. non-fulfillment of legal requirements for provision of electronic communication networks and/or services which affects the interconnection;
1.7. other conditions, set forth in the legislation.
Х. Conditions for geographic numbers portability
1. Orbitel ensures possibility for geographic numbers portability within one national district code, resp. for geographic number portability in case of change of the address within one geographic national district code.
2. The geographic numbers portability is ensured as per the Functional specifications for geographic numbers portability (approved with Decision № 2193 as of 23.10.2008 of CRC and promulgated in State Gazette № 96 as of 07.11.2008) and the Procedure for geographic numbers portability as of 13.05.2009 as well as in compliance with the operative legislation applicable to the regulation of the numbers portability.
3. The rules and conditions for ensuring the geographic numbers portability are determined in the General terms for interactions with the end users of the fixed telephone service, provided by Orbitel EAD.
